On the Export of Rice
(No. 13)
2002
Reference is made to the Ministry of Commerce Regulation on the Export of Rice (No.1), 1991, as amended by the Ministry of Commerce Regulation on the Export of Rice (No.12), 2002, prescribing the rules, procedures, and conditions governing the export of rice.
In the interest of the proper approval process, and in the interest of maintaining price stability for rice pending approval for export, by virtue of the Export-Import Act, 1979 Sections 7 and 25, and Ministerial Rules No.2 (1980) as issued under the Export-Import Act, 1979 that contains certain provisions pertaining to the limitation of rights and individual liberty; in this case the Constitution of the Kingdom of Thailand Section 29, in conjunction with Sections 31, 35, 48, and 50 allow for by the power of law, the Ministry of Commece herein issues additional regulation as follows:
Article 1. This regulation is called Ministry of Commerce Regulation
On the Export of Rice (No. 13), 2002.
Article 2. This regulation is effective from the date of its publication in the Government Gazette onwards.
Article 3. The Ministry of Commerce Regulation On the Export of Rice (No. 12), 2002 is hereby annulled.
Article 4. For every application and every selling amount agreed upon, the applicant for export of White rice and Cargo rice shall submit evidence of such sales or evidence of purchase demonstrating that such purchase and sale had taken place. In addition, the applicant shall certify the information and report the details such as the identity of purchaser, type, classification, and grade of White rice, Cargo rice, Thai Hom Mali Rice (whether Thai Hom Mali Rice, Thai Jasmine Rice, or Thai Fragrant rice, or any other name having the same meaning; whether containing words conveying the meaning of “Thai”), or Thai Hom Mali Rice as provided in specimen, or Mixed Thai Hom Mali Rice indicating the ratio of the mixture of Thai Hom Mali Rice and White rice or Cargo rice, themselves being yet other strains of non-glutinous rice mixtures as applicable (whether Mixed Thai Hom Mali Rice, Mixed Thai Jasmine Rice, or Mixed Thai Fragrant rice, or any other name having the same meaning; whether containing words conveying the meaning of “Thai”), the volume of the merchandise, FOB price per ton, final destination and tentative date of export.
The issuance of certificates of export for White rice, Cargo rice, or Thai Hom Mali Rice shall be as follows:
(1) Certificates for White rice or Cargo rice are to be issued as White rice or Cargo rice, indicating the applicable type and grade so as to demonstrate the strain of rice such as White rice (Pathumthani 1).
(2) Certificates for Thai Hom Mali Rice are to be issued as Thai Hom Mali Rice, or Thai Jasmine Rice, or Thai Fragrant Rice or other names having the same meaning according to the type and grade of that rice.
(3) Certificates for Thai Hom Mali Rice as represented by a specimen are to be isssued as Mixed Thai Hom Mali Rice, or Mixed Thai Jasmine Rice, or Mixed Thai Fragrant Rice, or other names having the same meaning according to the type and grade of that rice. In addition, the ratio of the mixture of Thai Hom Mali Rice with and White rice or Cargo rice, themselves being yet other strains of non-glutinous rice mixtures as applicable shall be provided.
Article 5. In the process of application as detailed in Article 4, the Department of Foreign Trade or any other agency so assigned by the Ministry of Commerce to inspect whether the rice whose application is being submitted is White rice, Cargo rice, Thai Hom Mali Rice, or Thai Hom Mali Rice as represented by the specimen with the appropriate type, classification, and grade as applied for export as appropriate.
Article 6. All relevant notifications, regulations, or other rules in effect prior to the effective date of this regulation shall remain in effect to the extent that they do not contradict or contravene this regulation.
Article 7. The Director General of the Department of Foreign Trade shall be responsible in administering this regulation.
